CONTRACT AND LIABILITY AGREEMENT
You are agreeing to the following terms and conditions by pushing the “I agree to the terms and conditions ICON.

1. In consideration for receiving permission to participate with Chelan Wine Tours and Excursions LLC , I HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE Chelan Wine Tours and Excursions LLC and their officers, agents, servants, or employees (hereinafter referred to as RELEASEES) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me and/or other family members that are using the transportation service, or any of the property belonging to me and/or other family members that are using the transportation service WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, while participating in such activity, or while in, on or upon the premises where the activity is being conducted.
2. I am fully aware of the unusual risks involved and hazards connected with this activity, including but not limited to travel risks and/or road hazards. I hereby elect to VOLUNTARILY PARTICIPATE in said activity with full knowledge that said activity may be hazardous to me and my property. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY, INCLUDING DEATH that may be sustained by me, or any loss or damage of property owned by me, as a result of being engaged in such activity, WHETHER CAUSED BY THE NEGLIGENCE OF RELEASEES OR OTHERWISE.
3. I further hereby AGREE TO INDEMNIFY AND HOLD HARMLESS THE RELEASEES from any loss, liability, damage or costs, including court costs and attorney fees that they may incur due to my participation in said activity, WHETHER CAUSED BY NEGLIGENCE OF RELEASEES OR OTHERWISE.
4. I understand that Chelan Wine Tours and Excursions LLC does not maintain any insurance policy, other than FLEET INSURANCE COVERAGE, covering any circumstance arising from my participation in this event or any activity associated with or facilitating that participation. As such, I am aware that I should review my personal insurance portfolio.
5. It is my express intent that this Waiver of Liability and Hold Harmless Agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE the above-named RELEASEES. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of Washington.

 

TERMS AND CONDITIONS

Chelan Wine Tours and Excursions LLC will strictly enforce State and federal laws and will maintain a zero tolerance compliance policy that no alcoholic beverages can be consumed or used by any person not of legal drinking age. All State law enforcement agencies have absolute power to stop any motor vehicle for administrative searches. If contraband is aboard, they can seize and forfeit this vehicle to a local government agency. Therefore no person will bring contraband aboard vehicles that are owned and operated by Chelan Wine Tours and Excursions LLC. Chelan Wine Tours and Excursions LLC will not be responsible for any injuries that may occur due to horse playing while the vehicle is in motion, at a standstill or entering and exiting vehicle. The purchaser on the front of this contract is responsible for his or her guests.

AT THE DRIVERS DISCRETION, THE PURCHASER AGREES TO BE FULLY LIABLE FOR ALL CHARGES THAT MAY OCCUR:

1. $150.00 per minimum for extensive cleanup (spills ,etc.)
2. $200.00 shampooing and disinfecting (due to sickness/vomiting)
3. $225.00 minimum for each burn hole, rip, or tear to upholstery.
4. $175.00 minimum for each act of vandalism
5. Downtime subject to Loss of revenue, per each hour lost as stated in contract.

Chelan Wine Tours and Excursions LLC recommends that all and any personal values be removed from the vehicle when unattended. We will not be held responsible for any lost, stolen or damage articles. Ultimate Party Bus Limousines reserves the right to terminate this or any other contract for noncompliance of the above/below request, especially if renters do not follow chauffeurs requests in order to obey the rules in this contract. No Smoking is allowed in our vehicles. All deposits (cash or credit card authorization) are non-refundable. The authorized cardholder for the given credit card is responsible for the payment of the total amount, per cash, credit card or money order. All of the given information from the renter is binding and cannot be changed without Chelan Wine Tours and Excursions LLC acceptance.

If the contract is cancelled after signed, Chelan Wine Tours and Excursions LLC is still authorized to collect the remaining balance in full, if the car was not re-rented again on the cancel date for the same or higher amount. We will reserve the said date upon the approval of the purchaser’s credit card. The credit card holder gives authorization to use the credit card information over the phone /fax/internet combination with signed contract. If the purchaser cannot provide all of the above items at the time of the pickup, Chelan Wine Tours and Excursions LLC will not start the job, as we have no proof of the legal possessions of the credit card. There for the risk of not getting paid will give us the right to cancel. The purchaser is still fully responsible to pay the total amount as he/she failed to fulfill the above requirements.

Base Price is simple transportation. Overtime will be billed by 1⁄4 of hourly rate .If customer fails to show at designated pick up location and does not inform the office and /or driver, the full amount of the contracted time will be charged. The purchaser authorizes Chelan Wine Tours and Excursions LLC to charge any additional charges after the rendered services to the purchasers’ credit card supplement charge. Customer agrees to have Chelan Wine Tours and Excursions LLC get authorization for the amount of the event and agrees to any extra charges as listed above. Chelan Wine Tours and Excursions LLC shall not be held responsible for late arrival caused by (but not limited to) act of nature, traffic delays, breakdown, incorrect pickup and drop off information, and any situation beyond our control, If the Vehicle rental is to include a minor under the age of (18) eighteen, a Parental Consent Form must be given to the driver at the pickup point. If at any time, any of the passengers under 21 are found to have in their positions, or have been at any time during the course of the service, been consuming any alcohol the service shall be terminated. Any and all monies shall be forfeited. Driver has the option of returning to the point of pickup or ending the service at the point of infraction or potential violence.

Any pictures taken on this event by Chelan Wine Tours and Excursions LLC will be property of such and may be posted on our website without permission from you or your guests.  

I, the credit card holder/purchaser, agree to pay Chelan Wine Tours and Excursions LLC upon signing this contract. I am satisfied with the terms and condition above and fully understand and agree.

IN SIGNING THIS RELEASE, BY PUSHING THE “I AGREE TO THE TERMS AND CONDITIONS ICON, I ACKNOWLEDGE AND REPRESENT THAT I HAVE READ the foregoing Waiver of Liability and Hold Harmless Agreement, Terms and Conditions, understand them and sign them voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this release for full, adequate and complete consideration fully intending to be bound by same.
